A wrongful death claim has the same elements as a negligence claim EXCEPT:

There is a two (2) year time frame to bring wrongful death claims.
An estate must be opened and a personal representative must be appointed.
 

A person’s estate and survivors both are entitled to damages when a loved one dies.

Damages such as medical and funeral expenses; loss of earnings over one’s lifetime; pain and suffering; loss of consortium; and loss of support and services can be collected against the person who caused your loved one’s death.

Only certain relatives are survivors and as such are entitled to collect damages when a loved one dies.
